CITY OF NORTHGLENN ZONING ORDINANCE

ARTICLE 13
MULTIPLE DWELLING ZONE, R-3

Section 11-13-1. Multiple Dwelling Zone, R-3. The provisions of this Article shall regulate and restrict the erection, construction, reconstruction, alteration, repair and use of buildings, structures, and land in zoning districts of the City of Northglenn established as Multiple Dwelling Zones, R-3.

Section 11-13-2. Uses-by-Right, R-3 Zone. In addition to the uses-by-right set forth in Section 11-7-6 of the Municipal Code, the following shall be uses-by-right in R-3 Zones:

(a)

Multiple dwellings.

(b)

Two-family dwellings, which are in compliance with minimum requirements for R-1-C zones.

Section 11-13-3. Special Uses, R-3 Zone. The special uses set forth in Section 11-31-3 of the Municipal Code shall be special uses in R-3 zones.

Section 11-13-4. Floor Area, R-3 Zone. The minimum floor areas in R-3 zones are the following:

(a)

Multiple dwellings: 450 square feet per dwelling unit.

(b)

Two-family dwellings: 1,100 square feet per dwelling structure and 550 square feet per dwelling unit.

(c)

Single-family dwellings: 800 square feet per dwelling

Section 11-13-5. Lot Area, R-3 Zone. The minimum lot areas required in R-3 Zones shall be:

(a)

Multiple dwellings: 13,500 square feet for the first three dwelling units plus 2,000 square feet for each additional unit.

(b)

Two-family dwellings: 9,000 square feet.

(c)

Single-family dwellings: As set forth in Section 11-11-5 of the Municipal Code.

Section 11-13-6. Lot Width, R-3 Zone.

(a)

The minimum width of any lot in a R-3 Zone used for multiple dwellings shall be 100 feet, measured at the front building line.

(b)

The minimum width of any lot in a R-3 Zone used for a two-family dwelling shall be as provided by Section 11-12-6 of the Municipal Code.

(c)

The minimum width of any lot in a R-3 Zone used for a single-family dwelling shall be as provided in Section 11-11-6 of the Municipal Code.

Section 11-13-7. Height Limitation, R-3 Zone. The maximum height of buildings in R-3 Zones shall be:

(a)

Thirty-Five (35) feet for principal buildings.

(b)

Sixteen (16) feet for accessory buildings.

Section 11-13-8. Front Setback, R-3 Zone.

(a)

The minimum front setback in R-3 zones shall be 25 feet, except as otherwise provided in this Section.

(b)

The minimum front setback when property in a R-3 zone fronts on a State or Federal highway shall be 50 feet.

Section 11-13-9. Front Setback, Accessory Building, R-3 Zone. Accessory buildings in R-3 Zones, other than private garages or carports, shall be totally located not less than five (5) feet to the rear of the principal building.

Section 11-13-10. Side Setback, R-3 Zone. The following minimum side setback requirements shall apply in R-3 zones:

(a)

All buildings on corner lots: 25 feet on the side street.

(b)

Multiple dwellings, principal buildings: 10 feet, except as otherwise required by Section 11-13-10(a).

(c)

Accessory buildings to multiple dwellings: 10 feet, except as otherwise required by Section 11-13-10(a) and except that:

(1)

If the accessory building is totally located within 40 feet of the rear lot line, no side setback is required.

(d)

Two-family dwellings and accessory buildings thereto shall comply with the requirements of Section 11-12-10 of the Municipal Code.

(e)

Single-family dwellings and accessory buildings thereto shall comply with the requirements of Section 11-11-10 of the Municipal Code.

Section 11-13-11. Rear Setback, R-3 Zone. The following minimum rear setback requirements shall apply in R-3 Zones:

(a)

Principal buildings: 20 feet.

(b)

Accessory buildings: No requirement.

Section 11-13-12. Units Authorized Per Acre, R-3 Zone. A maximum of 18 dwelling units per acre shall be authorized in R-3 Zones.

Section 11-13-13. Trash Containers. The provisions of Section 11-7-2(b) of this Zoning Ordinance notwithstanding, trash may be stored in R-3 zones in front of the front line of the principal building and within five (5) feet of the property line, subject to the following requirements:

(a)

Trash shall be stored only in trash containers acquired from, or approved in writing by, the City.

(b)

No more than two (2) such trash container(s) shall be located in front of the front line of the principal building or within five (5) feet of a property line.

(c)

The lids of all such trash containers shall be closed at all times, other than when trash is being placed in or removed from the container, with no trash visible or overflowing.

(d)

The exception to the requirements of Section 11-7-2(b) contained herein shall apply only to properties located in the R-3 zone developed as townhomes, and which are designated by geographic area by the City Manager or his designee, where storage of trash in accordance with the requirements of 11-7-2(b) is impractical.
